Please thank U.S. District Judge Robert R. Summerhays who blocked Biden’s move to lift Title 42 barrier to millions of illegal immigrants.

U.S. District Judge Robert R. Summerhays blocked the Biden administration’s move to lift Title 42 which was set to expire on May 23, 2022.  The Trump administration implemented Title 42 in March 2020 to control the spread of Covid.  The policy gives the United States the authority to immediately expel asylum seekers without a legal process.  Title 42 has been used to expel more than one million migrants at the southern border.  

Judge Summerhays, a President Trump appointee, ruled on May 20, 2022 that the restrictions must stay in place until a lawsuit by 24 states, led by Arizona, Louisiana and Missouri, is resolved in the courts. In the April 3 lawsuit, filed after the Centers for Disease Control and Prevention announced plans to lift the public health order, the states argued the policy needed to remain to avoid “wave of illegal migration and drug trafficking.”

The Department of Justice appealed Judge Summerhays’ ruling.  The administration claims that it will comply with the court’s order while the appeal is processed.
