The US House of Representatives passed legislation that would prohibit illegal aliens from voting in federal elections by requiring states to document citizenship.  H.R. 8281 Safeguard American Voter Eligibility (Save) Act was approved by the United States House of Representatives on July 10, 2024 by a vote of 221 – 198.   Only 5 Democrats voted for the bill and 10 Democrats did not vote on the legislation.

Safeguard American Voter Eligibility Act or the SAVE Act DESCRIBED

This bill requires individuals to provide documentary proof of U.S. citizenship in order to register to vote in federal elections.
Specifically, the bill prohibits states from accepting and processing an application to register to vote in a federal election unless the applicant presents documentary proof of U.S. citizenship.

Further, the bill (1) prohibits states from registering an individual to vote in a federal election unless, at the time the individual applies to register to vote, the individual provides documentary proof of U.S. citizenship; and (2) requires states to establish an alternative process under which an applicant may submit other evidence to demonstrate U.S. citizenship.

Each state must take affirmative steps on an ongoing basis to ensure that only U.S. citizens are registered to vote, which shall include establishing a program to identify individuals who are not U.S. citizens using information supplied by specified sources.
Additionally, the bill requires states to remove noncitizens from their official lists of eligible voters.

The bill allows for a private right of action against an election official who registers an applicant to vote in a federal election who fails to present documentary proof of U.S. citizenship.

The bill also establishes criminal penalties for registering an applicant to vote in a federal election who fails to present documentary proof of U.S. citizenship.

The Election Assistance Commission must, within 10 days, adopt and transmit guidance for implementing the bill's requirements to chief state election officials.


According to a March 2024 report by the Bipartisan Policy Center, at least three states and Washington, D.C. have municipalities that allow noncitizens to vote in certain local elections. Oakland, Calif. is currently attempting to enact a similar law, according to the report. Previously, New York City enacted a law allowing noncitizens to vote in local elections in 2021, but it was ruled unconstitutional by a state judge in 2022.

Lee and Roy Partner on Legislation to Secure Federal Elections May 8, 2024 

WASHINGTON – Sen. Mike Lee (R-UT), alongside Rep. Chip Roy (R-TX), introduced the Safeguard American Voter Eligibility (SAVE) Act. This crucial legislation seeks to ensure that only U.S. citizens participate in federal elections by requiring proof of citizenship for voter registration.

The SAVE Act is cosponsored by: Sens. Kevin Cramer (R-ND), Ted Cruz (R-TX), Tommy Tuberville (R-AL), Roger Marshall (R-KS), Ted Budd (R-NC), John Kennedy (R-LA), and Rick Scott (R-FL).

The SAVE Act amends the National Voter Registration Act, setting requirements for states to verify U.S. citizenship. It outlines acceptable documentation for proving citizenship and requires states to set up alternative verification processes for citizens without standard documents. Additionally, the legislation compels states to purge non-citizens from voter rolls and establishes federal penalties for intentionally registering non-citizens. 

““Illegal immigrants and non-citizens across the nation are being improperly registered to vote, allowing them to cast illegitimate ballots in federal elections,” said Sen. Lee.  “At a time when trust in voting is more important than ever, we must stop foreign election interference and pass the SAVE Act. Voting is both a sacred right and responsibility of American citizenship, and allowing the people of other nations access to our elections is a grave blow to our security and self-governance. I’m proud to stand with Chip Roy to save our democratic process and representative government.”

“U.S. citizenship is sacred, and foreign nationals shouldn’t be able to vote in America’s elections,” said Sen. Kennedy. “The SAVE Act would ensure that people who aren’t even citizens don’t cancel out Louisianians and Americans’ voices at the ballot box.”

"Under Joe Biden's watch, over 11 million illegal aliens are now here on U.S. soil. That's enough to replace the entire population of Kansas almost FOUR TIMES over," Sen. Marshall said. "Democrats motivations behind welcoming this influx of migrants has been clear: they believe these are future Democrat voters. While requiring U.S. citizenship for federal elections has long been a requirement, our legislation finally puts pen to paper on the exact documents a person will need to prove they are, in fact, an American citizen and eligible voter. Proof of citizenship as a requirement to vote in our elections should not be controversial- it is our responsibility to protect the integrity of our electoral process.”

By implementing rigorous checks for voter registration, this legislation would defend against improper voting and seek to restore confidence in the integrity of our federal elections.


Numerous states and municipalities allow people to register to vote without documentation.  This means anyone, including foreign nationals can register to vote in some jurisdictions.

America is not America if anyone in the world can officially vote for our leaders.

It is utterly irresponsible and un-American that one political party has decided that its future viability and power increasingly depends on building its voter base from non-Americans who enter the United States unlawfully.
