Congressman Randy Fine (Florida – R) and Congressman Keith Self (Texas – R) are co-sponsoring H.R. 5512 titled No Shari’a Act. The bill reads in part:
SECTION 5: APPLICATION OF SHARI’A
(a) PROHIBITION .—No court shall enforce a judgment, decree, or arbitration decision if it relies, in whole or in part, on Shari’a or any foreign law that violates the constitutional rights of any party.
(b) CONTRACTS .—A contract provision choosing foreign law shall be valid unless enforcement would result in a violation of constitutional rights.
(c) FAMILY LAW .—In matters involving marriage, divorce, child custody, adoption, or inheritance, no court shall apply or enforce foreign law if inconsistent with fundamental rights or public policy.
Many of the tenets of Sharia law are antithetical to the rights afforded under the United States Constitution. Sharia law deprives women, apostate Muslims and infidels of many of the legal protections that are otherwise afforded them under the United States Constitution. Additionally, Sharia law calls for cruel and unjust punishments, fatwas, honor killings, genital mutilations, discrimination, religious persecution and a host of other unconstitutional tenets. The Florida Family Association website offers this perspective on Sharia law.
Federal, state, county, city and school board officials take an oath to uphold the United States Constitution. However, we can see how many government officials and employees show total disregard today for the United States Constitution. The circumstance of not having federal law specifically prohibiting judicial enforcement of Sharia law or any foreign law will eventually lead to leftist judges issuing orders that empower the Islamist creed.
H.R. 5512 is currently in the House Committee on the Judiciary. House leadership may be inclined not to move this bill through because there is no companion legislation in the Senate. However, Senate sponsorship would be more likely if the House passes the bill.
Taking a vote on this legislation would make it clear to the electorate where all house members stand regarding the superiority of the United States Constitution and the tacit support for the radical, leftist Islamist ideology.
