Florida Family Association recently reported through an email alert that the US Department of Justice started investigating Mamdani's “unequal application of the law” after it received thousands of emails expressing concern regarding Mayor Mamdani's Muslim law enforcement bias.  This email adds to our prior notices to the US DOJ with the hope that charges will be filed soon.

The New York Police Department is allowing Muslim taxi drivers to double park for Muslim prayers while at the same time it is issuing citations to non-Muslim offenders.  

Nate Friedman published a report at Youtube.com regarding this situation.   

Nate asked an NYPD ticket officer why he was not ticketing Muslim taxi drivers who were double parked.  The officer replied “They are allowed in the time of Salah (prayer)" and “They are permitted to double park in the time of prayer.”

NYPD’s parking ticket bias favoring Muslims is unlawful on two counts.

First, a policy or practice of ticketing non-Muslims for double-parking while systematically exempting Muslim taxi drivers because they are Muslim (and only during the call to prayer) would be unlawful. Double-parking a passenger vehicle, including a taxi, is illegal in New York City at all times. Taxis are not treated as commercial vehicles for these purposes. Police have enforcement discretion, but that discretion is constrained by the Constitution.  Equal protection and religion. 

The Equal Protection Clause of the Fourteenth Amendment prohibits government from treating similarly situated people differently on the basis of religion. Religion is a protected classification. Selective enforcement that favors one faith while punishing others for the same conduct is classic discrimination. 

Courts analyze such claims by asking whether the government treated a person differently from similarly situated others and whether the difference was motivated by religion (or another forbidden consideration). A practice limited to Muslim taxi cabs during the call to prayer and applied against everyone else who are not Muslim would meet that test.  

Second, the Free Exercise and Establishment Clauses of the First Amendment add further limits. Government may not prefer one religion over others or over non-belief. An informal “no-ticket” rule that exists only for Muslim prayers, and not for comparable gatherings of other faiths or secular events, would raise both free-exercise and establishment problems.

NYPD’s biased enforcement of the law favoring Muslims is illegal.  Additionally, will Mayor Mamdani’s Muslim bias weaken NYPD’s counter terrorism surveillance efforts?   The New York Police Department Counterterrorism Unit plays a major role in protecting New Yorkers as well as Americans across the country from terrorism.

The United States Department of Justice must take action to prevent America’s largest city from becoming Islamist controlled like London.

Honorable Assistant Attorney General Dhillon,

The NYPD is failing to ticket Muslim taxi drivers who commit parking violations during Salah, while ticketing everyone else.  This action violates the Equal Protection Clause of the Fourteenth Amendment and Free Exercise and Establishment Clauses of the First Amendment.  I hope that, for the sake of the public safety of millions of people, such bias is not weakening the NYPD’s counterterrorism surveillance.  Please investigate.
